1. Agreement to Terms

By accessing or using sadly ("the Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the Service.

2. Description of Service

sadly is a private journaling service that operates through email. The Service allows you to:

• Receive daily journaling prompts via email
• Submit journal entries by replying to prompts or emailing journal@sadly.com
• View insights about your journaling patterns (word count, sentiment trends)
• Receive weekly summary emails

Important: We do not store your actual journal content. We only process it to extract metadata (word count, sentiment) and then immediately discard the text. Your journal entries remain in your email inbox.

3. Account Registration

To use the Service, you must register with a valid email address. You are responsible for:

• Providing accurate and complete registration information
• Maintaining the security of your email account
• All activities that occur through your registered email

We use passwordless authentication via magic links sent to your email address.

4. Free Trial and Subscription

sadly offers a 30-day free trial. After your trial ends, continued use of the Service requires a paid subscription.

Pricing

• Monthly subscription: $5 USD per month
• Billed monthly through Stripe

Grace Period

After your trial ends, you have a 10-day grace period during which you can still use the Service. After this grace period, you must subscribe to continue receiving prompts and having entries processed.

Cancellation

You may cancel your subscription at any time through the billing page or by contacting us. Your subscription will remain active until the end of your current billing period. We do not offer refunds for partial months.

5. Acceptable Use

You agree not to use the Service to:

• Send spam, malware, or other harmful content
• Violate any applicable laws or regulations
• Impersonate others or provide false information
• Attempt to gain unauthorized access to our systems
• Interfere with or disrupt the Service
• Use automated systems to send excessive emails to our service

We reserve the right to suspend or terminate accounts that violate these terms.

6. Privacy

Your privacy is fundamental to our service. Please review our Privacy Policy to understand how we handle your information.

Key point: We never store your journal content. Your actual journal entries remain in your email inbox, not on our servers.

7. Intellectual Property

The Service, including its design, features, and content (excluding user-submitted content), is owned by sadly and protected by intellectual property laws.

Your journal entries belong entirely to you. Since we don't store them, you maintain full ownership and control over your content at all times.

8. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that the Service will be uninterrupted, error-free, or completely secure. We are not responsible for any loss of data, including email delivery failures.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SADLY SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY.

Our total liability for any claims arising from your use of the Service shall not exceed the amount you paid us in the twelve (12) months preceding the claim.

10. Indemnification

You agree to indemnify and hold harmless sadly and its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from your use of the Service or violation of these Terms.

11. Changes to Terms

We may modify these Terms at any time. If we make material changes, we will notify you by email at least 30 days before the changes take effect. Your continued use of the Service after the changes take effect constitutes acceptance of the new Terms.

12. Termination

We may terminate or suspend your access to the Service at any time, with or without cause, with or without notice. Upon termination, your right to use the Service will immediately cease.

You may terminate your account at any time by contacting us. Your journal entries will remain in your email inbox regardless of account status.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions.

14. Dispute Resolution

Any disputes arising from these Terms or your use of the Service shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association. You agree to waive any right to a jury trial or to participate in a class action.

15. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
